Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and GutChat (“GutChat,” “we,” “us,” or “our”), the operator of the GutChat application and website (the “Service”). By creating a profile or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

The Service is intended only for adults. You must be at least 18 years old to use GutChat. By using the Service you represent and warrant that you are 18 or older. We do not knowingly collect information from anyone under 18.

GutChat helps you log and observe gut-health signals — sample readings, meals, symptoms, and lifestyle factors — and surfaces patterns and an estimated daily score for educational purposes.

• Not a medical device. GutChat is not a medical device and is not intended to diagnose, cure, mitigate, treat, or prevent any disease or condition.
• Not professional advice. Content in the Service, including AI-generated readings and coach responses, is informational only and is not a substitute for advice from a qualified physician, dietitian, or other healthcare professional.
• No provider relationship. Using GutChat does not create a doctor–patient or other professional relationship with us.
• Emergencies. Never disregard or delay professional medical advice because of something you read in the Service. If you think you may have a medical emergency, call your local emergency number or go to the nearest emergency room.

GutChat uses third-party artificial-intelligence models to interpret photos and text you provide (for example, estimating nutrition from a meal photo or description, or reading a sample image). These outputs are estimates and may be inaccurate or incomplete. Portion sizes, macros, and sample interpretations are approximations. Use your own judgment and consult a professional before acting on them, especially for medical or dietary decisions.

• Provide accurate information and keep your account credentials secure. You are responsible for activity under your account.
• Use the Service only for your own personal, non-commercial wellness tracking, and comply with all applicable laws.
• Do not misuse the Service — including attempting to reverse engineer it, disrupt it, scrape it, upload unlawful or infringing content, or use it to provide medical services to others.

The Service integrates and links to independent third parties that we do not control and are not responsible for:

• Telehealth and care directories. Any consultations are provided by independent, licensed providers. GutChat is not a healthcare provider and does not deliver care; we are not responsible for services those providers render.
• Shop / affiliate links. Some product links are affiliate links, and we may earn a commission at no extra cost to you. Listed products are general wellness products, not treatments. We do not manufacture, sell, or warrant them.
• AI and infrastructure providers. We rely on third-party AI model and cloud-hosting providers to operate the Service, as described in our Privacy Policy.

You retain ownership of the information you submit (photos, notes, logs). You grant GutChat a limited, non-exclusive license to process and store that information solely to operate and provide the Service to you, and — only if you expressly opt in — to contribute de-identified data to product research, as described in the Privacy Policy. You are responsible for the content you submit and confirm you have the right to submit it.

The Service, including its software, design, text, and branding, is owned by GutChat and protected by intellectual-property laws. We grant you a personal, revocable, non-transferable license to use the Service under these Terms. You may not copy, modify, or create derivative works from the Service except as permitted by law.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service or any AI output will be accurate, reliable, uninterrupted, or error-free.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUTCHAT AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold GutChat harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or applicable law.

You may stop using the Service and delete your data at any time from Settings. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute that is not otherwise resolved, except where prohibited by applicable law.

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you in the Service. Your continued use after changes take effect means you accept the updated Terms.
